1. Introduction

SoundBetter Inc. (“SoundBetter,” “we,” “us,” or “our”) respects your privacy and is committed to protecting personal information. This Privacy Policy explains how we collect, use, share, and protect personal information when you use Imagine Plugins (the “Service”).

2. Company Information

3. Information We Collect

3.1 Information You Provide: Name, email, business info, billing details, revenue tier selection, and account credentials.

3.2 Public and Shared Content: Information you choose to submit or publish, including branding or metadata.

3.3 Project Design and Plugin Development Data: DSP chain configurations, GUI layouts, builder tool usage, and build history.

3.4 User Assets: Uploaded image files and media used in plugin development.

3.5 Compiled Plugin Binaries: We temporarily retain binaries to facilitate downloads and provide technical support.

3.6 Payment Information: Processed via third parties (e.g., Stripe); we do not store full payment card details.

3.7 Automatically Collected: IP address, device info, browser info, and usage analytics.

3.8 Identity Verification: Data collected to prevent fraud or enforce pricing tier eligibility.

3.9 Data Minimization: We limit collection to data necessary to provide and secure the Service.

3.10 Email Subscription for Free Downloads: When you provide your email address to download free products such as Vocal Effect, we collect your email to deliver the download and, where you have opted in, to send you product updates and marketing communications from SoundBetter. You can unsubscribe at any time via the unsubscribe link in any marketing email or by contacting privacy@soundbetter.com.

4. Sensitive Personal Information (California Notice)

We may collect limited categories of Sensitive Personal Information as defined under California privacy law. This may include:

  • Account login credentials
  • Financial or billing verification data associated with payment processing

We do not intentionally collect Sensitive Personal Information such as biometric identifiers, precise geolocation data, government-issued identification numbers, or communications content unless required for fraud prevention, legal compliance, or security purposes.

Sensitive Personal Information is used solely to provide, secure, and operate the Service and is not used for profiling or behavioral advertising purposes.

California consumers have the right to limit the use or disclosure of Sensitive Personal Information as required under applicable law.

5. Automated Decision-Making and Profiling

We may use automated processing for fraud detection, abuse monitoring, and revenue tier verification. Where applicable law (including GDPR Article 22) grants you the right to request human review of an automated decision that produces legal or similarly significant effects on you, you may exercise that right by contacting privacy@soundbetter.com. This right applies to the extent required by law and may not apply to all automated processing described above.

6. How We Use Information

We use data to operate the Service, build and sign plugin binaries, perform technical reviews, provide debugging support, enforce licensing compliance, and comply with legal obligations. We also send product updates, newsletters, and marketing communications where you have provided consent or where permitted by applicable law.

7. Limited Internal Access and Human Review

Authorized SoundBetter personnel may access project data solely for technical review, signing, debugging, or investigating security threats. Access is subject to confidentiality obligations.

8. Legal Bases for Processing (EEA / UK)

Where required by GDPR, we process data under performance of a contract, legitimate interests, legal obligations, or user consent.

9. How We Share Information

We do not sell personal information. We share data with:

9.1 Service Providers: Including but not limited to Stripe, AWS/Google Cloud, Intercom, Google Analytics/Meta, and email service providers used to send transactional and marketing communications.

9.2 Corporate Affiliates: For operational purposes or in the event of a merger/acquisition.

9.3 Business Partners: We may share data with third-party business partners in limited circumstances, including: (a) copy protection or licensing technology providers engaged to protect plugins built using the Service; (b) marketing service providers engaged to promote the Service, subject to appropriate data processing agreements; and (c) a successor entity in the event of a merger, acquisition, or corporate reorganization involving SoundBetter. Any such sharing is subject to confidentiality obligations and is limited to data necessary for the applicable business purpose. We will update this policy if material new categories of business partners are added.

9.4 Legal Requirements: To protect rights, safety, or prevent fraud.

10. Cookies and Tracking Technologies

We use cookies (e.g., Google Analytics, and where implemented and consented to, Meta Pixel) to operate and improve the Service. We honor browser-based privacy signals where applicable.

11. Data Retention

We retain personal information for as long as necessary to provide the Service and fulfill the purposes described in this policy, subject to the following general timeframes:

Account and project data (including DSP configurations, GUI layouts, and build history): Retained while your account is active and for up to 2 years following account deletion, to allow for account reactivation, support continuity, and resolution of any disputes or legal claims arising from your use of the Service. After this period, project data is deleted or anonymized, except where longer retention is required by law or ongoing legal proceedings.

Compiled plugin binaries: Retained for the duration of your account's active association with the build record, and for up to 2 years following account deletion. This allows you to re-download your plugin, receive redelivery if needed, request updates or re-signing, and obtain technical support. Build records (metadata identifying what was built and delivered) may be retained for the lifetime of the Service for legal, dispute resolution, and delivery verification purposes. Binaries and build records are removed or anonymized upon expiration of the applicable retention period, except where longer retention is required by applicable law.

User-uploaded assets (images, branding files): Retained for up to 2 years following account deletion, consistent with project data retention, to support account reactivation. After this period, assets are deleted from active systems, subject to standard backup rotation.

Payment and billing records: Retained for up to 7 years as required for tax and financial compliance purposes.

Security and fraud prevention logs: Retained for up to 12 months, or longer where required by applicable law or ongoing investigation.

Retention periods may be extended where required by applicable law, legal proceedings, or regulatory obligations.

12. Data Security and Breach Response

We implement technical safeguards including encryption and controlled access. We maintain breach notification procedures to comply with GDPR and California regulations.

13. International Data Transfers

Personal information may be processed in the United States. We implement safeguards which may include Standard Contractual Clauses or other appropriate transfer mechanisms, where required by applicable law. We conduct transfer impact assessments where required by law.

14. Data Protection Impact Assessments

We conduct privacy and cybersecurity risk assessments to evaluate and mitigate risks related to automated processing.

15. Your Privacy Rights

16. California Privacy Rights (CCPA/CPRA)

California residents have rights to know, delete, correct, and opt out of the sale or sharing of personal information.

17. Independent Creation

Different users may independently create similar plugin functionality. SoundBetter is not responsible for similarities in functionality resulting from independent creation.

18. Third-Party Services

SoundBetter is not responsible for the privacy practices of third-party services integrated with the platform.

19. Children's Privacy

The Service is not intended for individuals under eighteen (18).

20. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. For non-material changes, we will update the “Last Updated” date at the top of this policy, and your continued use of the Service after the updated date constitutes acceptance. For material changes — including changes to the categories of data we collect, how we use it, or with whom we share it — we will provide advance notice by email to the address associated with your account or by prominent notice within the Service, at least fourteen (14) days before the changes take effect. Your continued use of the Service after the effective date of a material change constitutes your acceptance of the revised policy. If you do not agree, you should discontinue use of the Service before the effective date.
